Driver with camera equipment will face heavy penalties. Global surveillance out of the car by private individuals is not permitted. It made on Monday the ARGE Daten attention after the Data Protection Commission has issued a corresponding projects an applicant rebuffed. Following this decision, the ARGE, can expect up to 25,000 euros in case of recurrence every motorist with a video equipment with a display and an administrative penalty in the amount of up to 10,000 euros. Unwanted filmed people could moreover civil damages claim up to 20,000 euros. For a preventive video surveillance by private driver namely lacking the legal basis. But may continue to be filmed and photographed after an accident to preserve evidence. In this case, mainly legal interests can be asserted. The background: For the protection of your own car and "to meet legal duties of care" was trying to register the mobile video surveillance out of his car, a private individual. The applicant compared the video recordings that are created as by tourists or helmet cameras of athletes. Since the recording should be evaluated solely by the applicant, he saw the data use in personal purpose was reasonable and demanded an arbitrarily long retention period of the video material. That his car had become target of a dangerous attack, the man was unable to substantiate. The Privacy Commission stated: Permanent records of the car is video surveillance. The true purpose is not personal or family (like a wedding or holiday), but the evidence in the event of an accident. Therefore, comparisons with shots of tourists or helmet cameras are not true. Individuals, the ARGE data, may only monitor those areas that are attributable to its sphere of influence - ie their home, your home or premises. The surveillance of public space is solely responsible for the security agencies. -- Ausfahrt. The biggest city in Germany. |

Regelung in Österreich
